出口业务善后函

出口业务善后函当出口方(或议付行)向开证行提交整套单据后,业务就进入了善后阶段.此时,开证行会对所提交的单据进行审核、以确定其表面上是否符合信用证条款.如果开证行对单据没有提出异议,说明出口方已得到开证行的付款保证.进口方在目的港接受货物后,本笔交易就可视为顺利完成.但如果开证行认为单证不一致,就会拒付.这对出口方来讲,无疑意味着以银行信用为基础的信用证付款方式失败.收到银行的拒付通知后,出口方一定要先确定遭到拒付的原因,与国内议付行相配合,做好应变工作,共同把因无法正常收汇而因产生的风险和损失降至最低.同时还应迅速与进口方联络,寻求解决办法,尽量说服进口方接受货物.
拟写善后业务函是出口方是一个重要步骤,它是对整笔业务的回顾,这对于确立买卖双方间长期的业务关系是非常有帮助的.由于面临的情形不同、善后函又可分为如下两大类:
一、开证行接受单据时的善后函由于此时整笔交易进展得非常顺利,写法上就显得相对比较随意.出口方可以回顾该笔交易中值得肯定的地方、诸如感谢对方所做的努力、对交易增进了双方的了解表示高兴等、也可以展望未来,如希望能继续扩大合作,收到更多的订单,建立长期业务往来关系,或借此推荐新产品等等.例如:
We are glad to know that the issuing bank has honored our draft against LC No. ET688.
We hope this deal will be the basis of the further development of our business relationship.
We can ensure you that you will find the goods shipped to your entire satisfaction. We are looking forward to your repeat orders.
We trust that through our joint efforts, we will haveamore profitable future.
We would take this opportunity to recommend to our new products.
二、遭到开证行拒付时的善后函虽然这类善后函会因单证不符的内容而写法各异,但总的来说,由于出口方处于极不利的地位、语气应当诚恳,委婉、并且具有说服力、已赢得买方的谅解,比如对由此造成的不便表示抱歉、回顾双方以往的愉快合作等.更重要的是,出口方应当强调单证不符点是细微的,并不影响实际商品的品质,不会对进口方的实际利益造成损害.例如:
We are very concerned to receive the Notification of Dishonor from the issuing bank.
We feel deeply sorry for the mistake in our negotiation documents, which is made asaresult of our clerks carelessness.
We really hope this incident will not affect negatively our friendly cooperation.
We can guarantee that the quantity of the goods is exactly in the line with the stipulations of the relative contract.
Since our goods have been shipped on time, would you be kind to make the payment through your bankYou may rest assured that suchamistake will never occur again.
